A Whitehorse Mountie Will Have to Wait to Find Out if He'll Have a Criminal Record for Sexual Assault

The Defense wants Stephan Knaack to get a conditional discharge, while the Crown is seeking a suspended sentence.

A Whitehorse Mountie will have to wait to learn whether he will have a criminal record after pleading guilty to sexual assault in the workplace.

The lawyer representing Constable Stephan Knaack says his client should receive a conditional discharge, claiming the sexual assault was on the lower spectrum, noting that Knaack did not have a previous criminal record.

The Crown argued for a suspended sentence claiming RCMP officers hold a position of power and authority. The suspended sentence would carry a criminal record.

According to an agreed statement to the court, on January 4th, 2017 Knaack approached a female colleague, made an inappropriate sexual comment and then hugged the woman and grabbed her buttocks. Knaack was on duty at the time and the woman did not consent to the touching. The judge has reserved his decision.
