Federal Government to Appeal Ross River Decision

Ottawa has concerns over obligations to 1870 Order.

The federal government too is appealing a Yukon Supreme Court ruling on two recent lawsuits involving both Ottawa and the Ross River Dena Council.

In October Justice Leigh Gower ruled that the Federal Government had a constitutional obligation to address Ross River's concerns stemming from an 1870 Order, which is still in effect. Gower also ruled that Ottawa tried to meet its obligation to settle a land claim, yet despite years of negotiations, a treaty was not settled.

The federal government wants the appeals court to set aside the decision addressing the constitutional obligations within that 1870 and to set aside, that the order is still in effect.

Ross River is also appealing based on constitutional grounds.
